Terms of Service

1. Acceptance of Terms

By creating an account or subscribing to Blue Harbor Property Services ("Blue Harbor", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. The Service

Blue Harbor provides doorstep valet trash pickup at participating properties on scheduled pickup nights. Additional resident and property services may be offered over time, some delivered directly by Blue Harbor and others through independent service providers connected by Blue Harbor. Service availability depends on your property being an active partner community. Service begins August 1, 2026.

Additional resident services currently include Cleaning Services, Handyman Services, and Moving Services. Moving Services are coordinated through independent moving-service providers connected by Blue Harbor and always require a custom quote — submission of a moving request does not guarantee availability, move dates are not confirmed until Blue Harbor sends written confirmation, and final pricing depends on the approved scope. Undisclosed stairs, access restrictions, heavy or specialty items (including safes, pianos, and oversized appliances), or additional inventory discovered on-site may require a revised quote; no added charges may be collected without your prior approval. Customers are responsible for identifying fragile, valuable, hazardous, or prohibited items before service, and the assigned vendor may require additional terms based on the specifics of the move.

Blue Harbor service is subject to property authorization, lawful access to the premises and disposal facilities, and compliance with community rules. Joining a waitlist or creating an account does not guarantee service availability. Property partnerships are governed by separate written service agreements between Blue Harbor and the property; this Terms of Service applies to your individual use of the Blue Harbor website and any direct-to-resident subscription you create.

3. Resident Rules & Service Window

Customers must place trash in accordance with Blue Harbor's published service rules. If containers are required for a specific property, those requirements will be communicated before service begins. Blue Harbor does not provide bins as a standard part of service unless explicitly stated for your property.

  • Pickup nights and the trash-placement window are established for each participating community. Place securely tied bags outside your door only during your property's published service window on designated pickup nights.
  • Collection is completed by the end of your property's published route window on pickup nights.
  • Bags must be tied, leak-free, and contained according to your community's posted rules.
  • Recycling, when offered at your community, must be clean, dry, and bagged separately.

4. Prohibited Items

The following items are not accepted as part of standard valet trash service:

  • Hazardous materials
  • Chemicals
  • Paint
  • Batteries
  • Medical waste
  • Sharps
  • Liquids
  • Construction debris
  • Furniture
  • Appliances
  • Tires
  • Bulk items, unless separately scheduled
  • Any items prohibited by local law or your property's rules

5. Billing (Direct-to-Resident Subscriptions)

Where individual resident enrollment is available, direct-to-resident subscriptions are billed in advance on a recurring monthly basis through our payment processor (Stripe). Resident subscriptions are month-to-month; you may cancel at any time from your account, and cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. We may change prices with reasonable advance notice by email; price changes apply to the next billing period. Applicable taxes and fees may be added where required. Failed payments may result in suspension of service after reasonable notice. Property-sponsored arrangements are billed separately under the applicable written service agreement between Blue Harbor and the property; that arrangement controls for property-sponsored residents.

6. Missed Pickups & Compliant-Pickup Definition

A compliant pickup means trash was placed out during the approved service window, securely tied, contained according to service rules, and did not include prohibited items. If Blue Harbor misses a compliant pickup, customers should contact us promptly so we can review and resolve the issue. Remedies may include a courtesy pickup, account credit, or other resolution at Blue Harbor's discretion. Pickups missed due to non-compliance with the rules above are not eligible for remediation.

7. Suspension & Termination

We may suspend or terminate service for repeated rule violations, non-payment, abusive behavior toward staff, or if your property exits our service network. We will provide reasonable notice when possible.

8. Liability

Blue Harbor is not liable for items mistakenly discarded, damage to containers provided by the resident, or indirect or consequential damages. Our total liability is limited to the fees you paid in the preceding three (3) months.

9. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. We do not sell personal information.

10. Service Interruptions and Force Majeure

Service may be interrupted by hurricanes, flooding, severe or unsafe weather, emergency conditions, or other circumstances beyond our reasonable control. Pickup schedules may also change for federal holidays; we will communicate adjustments by email or in-app notice where practical. Blue Harbor is not liable for delays or missed pickups caused by force majeure or unsafe conditions.

11. Account Eligibility and Electronic Communications

Accounts may only be created by individuals 18 years of age or older. You are responsible for keeping your account information accurate. You consent to receive service-related communications electronically.

12. Third-Party Partner Services

Blue Harbor may list independent service providers in a partner directory. Transactions and services delivered by third-party providers are between you and that provider; Blue Harbor is not a party to and is not responsible for those services unless we expressly say so in writing.

13. Governing Law; Miscellaneous

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Venue for any dispute lies in the state or federal courts located in Galveston County, Texas. If any provision is found unenforceable, the remainder will continue in effect. We may assign these Terms in connection with a corporate transaction. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable written service agreement, constitute the entire agreement between you and Blue Harbor regarding the service.

14. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes constitutes acceptance.
